Harassment on the grounds of sex or sexual orientation within the scope of business management, when the employer was knowledgeable and did not adopt measures to prevent it.

Failure to prepare or implement the equality plan.

Fine: € 6,251 to € 187,515.

 

Failure to observe the safety and health protection standards during pregnancy and lactation.

Fine: € 40,986 to € 819,780.

 

Request personal data that constitute discrimination for access to work.

 

Fine: € 6,251 to € 187,515 + accessory penalty *: replaceable by drawing up and applying an equality plan. Non-compliance: penalty for non-elaboration or implementation.

Sexually harass.

Prison from 3 months to 1 year or a fine from 6 to 14 months.

 

Accessory penalties: company closure; dissolution; suspension up to 5 years; prohibition to develop similar activities in the future; intervention of the company up to 5 years.

Impose workers, through abuse of need or deceit, working conditions or Social Security that harm their rights.

 

Prison from 6 months to 3 years and a fine from 6 to 12 months.

 

Seriously discriminating in employment and, after an administrative requirement or sanction, does not repair the damages.

 

Prison from 6 months to 2 years or a fine from 12 to 24 months.

 

Failure to provide the necessary means for them to carry out their work with the necessary safety and hygiene measures, seriously endangering their health, life or physical integrity.
